Transport conditions - TAXI smile-Rastislav Tomečko
1.1 The company TAXI smile-Rastislav Tomečko (hereinafter referred to as TAXI smile) operates Taxi smile transport of persons, luggage, things and animals transported with them".
1.2 All TAXI smile drivers hold a valid group B driver's license and have many years of experience driving many types and types of vehicles. All TAXI smile cars are insured in accordance with valid legal regulations.
1.3 For the purposes of these transport conditions, the following terms are further defined in this paragraph:
"Transporter" - Taxi smile company - Rastislav Tomečko
"Client" - a natural or legal person for whom TAXI smile arranges transportation on the basis of an order;
"Transportation" - transportation of persons and the luggage, belongings and animals transported with them based on the client's order;
"Conditions of transport" - regulate the rights and obligations of the carrier and the client when carrying out the transport;
"Driver" - an employee of the company TAXI smile-Rastislav Tomečko
"Contract of carriage" - contract of carriage of persons and the luggage, belongings and animals transported with them in accordance with the relevant provisions of the Civil Code;
"Force majeure" - is a traffic accident not the driver's fault, traffic jam, floods, civil unrest, armed conflicts, states of war...
1.4 These transport conditions are binding for the client from the moment they became familiar with them and/or when they were referred to when concluding the transport contract.
Contract of Carriage
2.1 TAXI smile arranges transportation for the client on the basis of an order placed by the client, in person, by telephone, by email or via the order form on the website www.taxismile.cz Each of the contracting parties bears the costs associated with ordering transportation.
2.2 The transport contract is concluded the moment the client gets into the transporter's vehicle with the driver's permission.
The client has the right to safe transportation in accordance with the legal regulations in force in the Czech Republic to the place he designates. The client has the right to determine the route of transport, if it is in accordance with the legal regulations in force in the Czech Republic, to demand proof of payment from the driver and to terminate the transport of the car at any time.
Obligations of the client
4.1 The client is obliged to heed the driver's instructions regarding ensuring the safety of transport and the transport itself. In case of serious reasons, the client is obliged to get out of the vehicle at the driver's instruction.
4.2 The client is obliged to wear a seat belt during transport, throughout the entire period of transport, starting with getting into the vehicle and ending with getting out of the vehicle.
4.3 In order to maintain safety, the client is not allowed to:
interfere in any way with the driving of the vehicle,
give driving instructions to the driver, as a result of which there would (could) be an offense against the safety and smoothness of traffic on the roads (violation of road traffic rules) or a violation of other legal regulations (e.g. requiring the vehicle to stop in places marked with a prohibition sign stopping, requiring the vehicle to enter a place marked with a road sign prohibiting the entry of all vehicles, etc.),
open the vehicle doors while driving, prevent their opening or closing, get in or out while the vehicle is in motion, lean out of the windows,
throw objects from the vehicle, or leave objects protruding,
get into a vehicle that is fully occupied,
make it impossible or difficult for the driver to have a safe view from the vehicle or otherwise interfere with the driver's space,
be noisy, play loud music or behave inappropriately towards the driver,
eating in the vehicle, smoking or taking drugs,
pollute other customers or the vehicle with your actions, clothing or luggage, or otherwise damage the vehicle,
put luggage on the seats.
Conditions of carriage of children
5.1 Children under the age of 18 can only be transported with the consent of the legal representative. The driver is entitled to refuse to conclude a transport contract if the client does not provide the consent of the legal representative.
5.2 Children lighter than 36 kg and shorter than 150 cm are transported only in child car seats. The client undertakes to notify the request for the transport of children whose body weight does not exceed 36 kg and body height does not exceed 150 cm, with sufficient advance notice - at least 12 hours in advance. If the transport is provided in the municipality, this notification is not necessary. The child must not be transported in the seat next to the driver and must be fastened with a seat belt. However, if a child car seat is used when transporting a child in the village in a taxi service vehicle, the child must be placed in a seat that is equipped with an airbag that has not been deactivated, or if it has been deactivated automatically, the child must not be transported facing forward in the child car seat against the direction of travel. When transporting a child in a car seat, the manufacturer's conditions for placing the car seat in the vehicle must be observed.
Conditions of carriage of baggage and animals
6.1 TAXI smile undertakes to mediate the transportation of the client's luggage either together with the client and under his supervision, or separately, in which case it undertakes to mediate the transportation of the luggage to the destination. The driver is entitled to refuse to conclude a contract for the carriage of luggage (always including its contents) which could jeopardize the safety

Furthermore, the driver is entitled to refuse the transport of luggage (its contents) that are easily damaged, fragile or valuable (crystal chandelier, etc.).
6.2 At the same time, the client is obliged to properly and demonstrably warn the driver about the easily damaged, fragile or valuable nature of the luggage or its contents, otherwise the driver is not responsible.
6.3 The client is responsible for the supervision of luggage transported in the vehicle cabin outside the luggage compartment.
6.4 Dangerous baggage, i.e. things (substances) whose transport or handling is subject to special legal regulations, such as weapons, ammunition, dangerous substances and objects that can cause explosion, fire, vehicle damage, injury, poisoning, burns and illness people and animals, may only be transported on the basis of the express prior written consent of TAXI smile. The client is obliged to notify the transport of dangerous luggage when ordering the transport.
6.5 The client is obliged to notify the transport of valuable luggage with a total value of CZK 250,000 or more. Such baggage may only be transported on the basis of the express prior written consent of TAXI smile.
6.6 Live animals may only be transported in a transport box if there is no threat to the safety of the driver, transported persons, animals or road traffic safety.
6.7 The client is obliged to ensure the transport of a live animal in such a way that it does not contaminate people, the vehicle and does not endanger the driver and transported persons, especially with the leash and muzzle. In the case of transporting an animal in the luggage compartment, the animal must be transported in a sufficiently large and strong box with an impermeable bottom, which is intended for transporting animals. The client is responsible for the damage caused by the transported animal to the vehicles.
6.8 Strollers, wheelchairs, skis, snowboards, bicycles, etc. can only be transported if the vehicle has sufficient transport capacity and other luggage and the vehicle are not damaged. The client undertakes to notify the request for the transport of the above-mentioned luggage in advance before the start of the transport as part of the transport order.
6.9 In the event of damage, loss, theft of luggage or other movable objects, the client must be demonstrably notified immediately upon arrival at the destination or at the end of the transport, i.e. before exiting the vehicle. At the request of the client, the driver is obliged to comment on such a notification by the client. Without a written statement, the client cannot claim damages. TAXI smile is not responsible for damage or loss of transported luggage in the event that the damage or loss occurs as a result of the inappropriate (inappropriate) nature of the packaging of the transported item or the luggage itself, the actions of the client, force majeure, or on the basis of removing the consequences of force majeure.
Driver's rights TAXI smile
7.1 The driver is entitled to refuse transport in the event of non-fulfillment of the conditions specified in Article 3 of the TAXI smile Transport Terms or in the case of exceeding the maximum load of the vehicle or exceeding the maximum number of transported persons than is allowed in the TP of the vehicle.
7.2 The driver is entitled to terminate the transport if the TAXI smile driver's rights are threatened or restricted or if the client interferes with driving the car. 7.3 The driver is entitled not to conclude a transport contract or to withdraw from it if the place to which the client is to be transported is not reachable or can only be reached with extraordinary effort.
Duties of a TAXI smile driver
8.1 When transporting a client, the TAXI smile driver is obliged to comply with all regulations and to behave in such a way as not to cause any damage.
8.2 The TAXI smile driver is obliged, if the client asks him to do so, to help the client get into the car and store luggage.
8.3 The TAXI smile driver is obliged to issue a proof of payment to the client after receiving payment from the client.
The client is obliged to pay the price for the transport according to the valid TAXI smile price list, which is published on the website www.taxismile.cz, after the end of the transport in cash, by credit card or, in the case of a contractual client, by paying the invoice.
10.1 Neither the driver nor TAXI smile is liable to the client for damage in the event that the driver was not ready to take the client on time for a reason that was not the driver's fault (e.g. calamity, detour, traffic accident, impassable road, etc.)
10.2 All legal relations between the client and TAXI smile are governed by Czech law.
10.3 These transport conditions enter into force on 1/1/2021 and cease to be effective upon publication of the new transport conditions on the website www.taxismile.cz.
